Lasting Power of Attorney - Support

The Lasting Power of Attorney documents are probably the most important Legal Documents, you can put in place, whilst you are alive.

There are two Lasting Power of Attorney Documents (LPA documents)

  • Property and Finance

  • Health and Welfare

The documents are essentially about putting people in place you trust the most to help you "whilst you are alive" these people are the attorneys within the document. The documents are aimed more at "Mental Capacity" ie if you lost mental capacity your attorneys (trusted people) could help you. It should be noted within the Property and Finance document an option exists where your Trusted people can help you as soon as the document is registered. This is quite useful, if you need people to help you carry out activities such as paying companies, or doing some financial transactions.

The important thing to note here is that Lasting Power of Attorney is setup between "You" and the "Office of Public Guardian" and your documents are going to begin with you, get sent to the Office of Public Guardian and then get sent back to you. So when paying for assistance, what you are really paying for is for "an intermediary".

If your family situation is relatively simple, in terms of who you would have as your Attorneys (trusted people) there isn't necessarily a huge amount of legal advice to be given, its not to say it isn't useful, or not important, but its information that is readily accessible to you via the government website.

A lot of people wrestle with how they will put these in place, in terms of who they will use (often driven by cost and convenience) and as a result can end up, simply putting it off. It can seem like scaremongering when people talk about the results of not having LPAs in place, when they are needed (which involves the court of protection).

There seems to be a wide gulf between a percieved "high cost solicitor type service" and a cheaper"I'm doing it all myself on the internet, but worried its OK type of service" again leading to procrastination

The best option for a lot of people will be a guided support service and that is what we provide at Heredix, via two offerings

  • Option 1 Guided LPA. Price £100 per document.

    Most clients choose this option. It gives you guidance to complete your LPA yourself while ensuring everything is correct:

    • 60 minute Zoom consultation, includes education of the process end to end.

    • Live screen-share walkthrough of the Office of the Public Guardian system.

    • Clear checklist and step-by-step instructions on what information to enter and where.

    • You complete the LPA in your own time.

    • Scan or photograph each page of the signed document and send it to us electronically Tip: On Iphone, use the built-in scanner in Notes (tap the camera icon and select "Scan Documents")

    • We review your completed LPA documents and confirm whether they are ready for submission or highlight any corrections needed.

  • Option 2 Done-With-You LPA (Premium). Price £200 per document

    • 60 minute Zoom consultation, includes education of the process end to end and also includes full information gathering for forms

    • We complete forms online for download and printing and we send printed copy out to you in the post, with clear instructions on who needs to sign and date where.

    • You complete the required signatures and dating of the forms, in your own time.

    • You scan or photograph each page of the signed documents and send it to us electronically Tip: On Iphone, use the built-in-scanner in Notes (tap the camera icon and select "Scan Documents"")

    • We review your completed LPA documents and confirm whether they are ready for submission, or highlight any corrections needed.

Note - Clients will still have to pay the government registration fee, at the point the Office of Public Guardian register the documents.
